Condominium Ownership Rights for Foreign Nationals in Thailand

Foreign nationals are legally permitted to purchase and own condominium units in Thailand, provided they meet the requirements established under Thai law.

Section 19 of the Condominium Act B.E. 2522 (1979) specifies the categories of foreign individuals and juristic persons who may legally acquire ownership of condominium units.

Understanding these requirements is an important step for foreigners planning to purchase residential property or invest in condominiums in Thailand.

1. Legal Rights of Foreigners to Own Condominiums

Under Section 19 of the Condominium Act B.E. 2522 (1979), foreign nationals and juristic persons considered foreign under Thai law may own condominium units if they fall within one of the legally recognized categories.

Category 1: Foreign Nationals with Permanent Residence

Foreign nationals who have been granted permission to reside in Thailand under the Immigration Act may qualify to own condominium units.

Category 2: Foreign Nationals Permitted to Enter Thailand Under Investment Promotion Laws

Foreign nationals who have received permission to enter Thailand under the laws governing investment promotion may qualify for condominium ownership.

Category 3: Certain Juristic Persons Registered Under Thai Law

Juristic persons specified under Sections 97 and 98 of the Thai Land Code and registered under Thai law may qualify to own condominium units.

Category 4: Foreign Juristic Persons with Investment Promotion Approval

Certain foreign juristic persons that have received investment promotion approval under the applicable legislation may qualify for condominium ownership.

Category 5: Foreign Nationals Bringing Funds into Thailand

Foreign nationals or qualifying foreign juristic persons may acquire condominium ownership by meeting the financial requirements specified under Section 19.

These arrangements may involve:

  • Bringing foreign currency into Thailand
  • Withdrawing funds from a Thai baht account belonging to a person residing outside Thailand
  • Withdrawing funds from a foreign currency deposit account

The relevant transaction must comply with the applicable legal and banking requirements.

2. Proof of Funds for Condominium Purchases

One of the important requirements when registering the transfer of condominium ownership is providing evidence of the source of funds used to purchase the property.

Foreign buyers qualifying under the foreign-currency provisions must provide appropriate financial documentation demonstrating that the purchase funds meet the applicable requirements.

Foreign Exchange Transaction Form (FET)

A Foreign Exchange Transaction Form (FET) is a banking document used to confirm qualifying foreign currency transactions.

Depending on the transaction and applicable banking requirements, the buyer may need to obtain:

  • A Foreign Exchange Transaction Form (FET)
  • A bank-issued certificate confirming the transfer of funds into Thailand
  • Other acceptable evidence of the qualifying foreign currency transaction

The relevant documentation must be presented to the Land Office when registering the transfer of condominium ownership.

3. Registration of Condominium Ownership

Once the buyer has satisfied the applicable legal requirements and prepared the necessary financial documents, the ownership transfer may proceed through the relevant Land Office.

The Land Office will review the required documents and determine whether the transfer meets the applicable legal conditions.

Proper documentation is important to ensure that the condominium ownership transfer can be registered.
